About these terms
StitchQuill (stitchquill.com) is operated by 95 Solutions LLC ("we", "us", "our"). By creating an account or placing an order, you agree to these terms, our refund policy and our privacy policy. If you are ordering for a business, you confirm that you can accept these terms on its behalf. Questions about these terms can go to support@stitchquill.com.
Accounts
You need an account to place an order. You can create one in the order form or on the registration page. Please give accurate details and keep them up to date, especially your email address, because proofs, quotes and order updates are sent there.
You are responsible for keeping your password private and for activity on your account. If you think someone else has access to it, change your password and let us know. We may suspend or close an account that is used for fraud, abuse of offers (such as creating several accounts to claim more than one free first design) or artwork we are not willing to work on.
Orders and quotes
When you place an order, the order form shows the price for the options you chose before you submit. That is the price for the order as described. If the finished size, placement, fabric or complexity you entered turns out to be very different from the artwork you uploaded, we will contact you before starting work, and the price may change only if you agree.
Some jobs are quoted instead of priced instantly, such as designs over 14 inches or unusually complex work. For a quoted job, we review your artwork and send you a price. Work starts only after you accept the quote.
We may decline any order, for example if the artwork is unreadable, the request falls outside what we do, or it breaks the artwork rules below. If we decline an order, you are not charged.
Your artwork and your rights to use it
By uploading artwork, you confirm that you own it or have permission to use it for the work you are ordering. You are responsible for any claim that your artwork, or the products you make with our files, infringe someone else's trademark, copyright or other rights.
We may refuse or stop work on artwork that we believe infringes a trademark or copyright (for example, sports team or brand logos submitted without permission), or that is hateful, obscene, threatening or otherwise offensive. We do not have to explain every refusal in detail.
We keep your artwork private. We will not show it in our portfolio or anywhere else without your written permission.
Ownership of the files we make
Once an order is paid in full, you own the custom stitch files, vector files and worksheets we made for that order, and you can use them for any lawful purpose, including producing goods for your own customers. This does not give you ownership of the underlying artwork if it belongs to someone else.
We may keep copies of your artwork and finished files so you can download and re-order them from your dashboard, and so we can handle revisions, edits and support. We do not sell or reuse your custom designs for other customers.
Until an order is paid, the proof and files remain ours, and you may not use the proof image or any preview to produce goods.
Proofs, revisions and edits
Every order includes a stitch simulation proof and a PDF worksheet showing stitch count, size and color sequence. The proof is a digital simulation, not a photo of a physical sew-out. Please check it carefully, including spelling, colors and size, before you approve.
Revisions to the proof are unlimited until you approve it, as long as they relate to the design you ordered. A different design, a new logo or a much larger size counts as a new order. After delivery, minor edits (such as a color change, a small text correction or a density tweak) are free for 30 days. Resizing by more than about 20 percent counts as a new size and is charged at $6.
Payment
You pay after you approve the proof. Nothing is charged before approval. You can pay through PayPal, which accepts PayPal balances and most cards, by a bank payment (Zelle, US bank transfer, international wire or Wise, where offered on your order), or with prepaid credits from your account. Your files become available for download as soon as payment is complete. For bank payments, that is when the money has arrived in our account and we have confirmed it.
Bank payments must be sent in US dollars for the full amount shown, with your order number (or credit pack reference) as the reference. You pay any fees charged by your bank, Wise or an intermediary bank, and if less than the full amount arrives we will ask you to send the difference before the files are released. International wires are available above the minimum amount shown on the order. If online payment is ever unavailable, we may send a PayPal invoice instead.
Prepaid credit packs are paid in advance. Credits do not expire and can be used on any order. Regular shops can ask for weekly invoicing, which we may offer at our discretion. All prices are in US dollars.
Your first design is free up to $24 of design value for new accounts, limited to one per customer or business. Larger designs get that amount off, and rush or express fees still apply. The full rules are on the free first design page.
Price changes
We may change our prices at any time by updating the pricing page. The price shown when you submit an order, or the quote you accept, is the price for that order, even if prices change before you approve the proof. Credits already bought keep their full value.
Turnaround times
You choose standard (24 hours), rush (12 hours, $5) or express (6 hours, $10) turnaround. Turnaround is counted from when the order is placed, or for quoted jobs, from when you accept the quote. These times are the delivery estimates we work to for the first proof. Time spent waiting for your reply to a question about your artwork, and time for revision rounds, is not included. Our guarantee and its limits
If a file we digitized does not sew cleanly on the machine and fabric given in your order, send us a photo of the sew-out and we will fix it free. If we cannot fix it, we refund that order. See our guarantee for what we need from you.
Embroidery results also depend on things outside our control. We are not responsible for problems caused by machine condition or settings, thread tension, needles, thread, hooping, stabilizer, operator error, or sewing the file on a different fabric, size or garment than the order stated. We do not guarantee that a design will look exactly like printed artwork, because thread cannot reproduce every fine detail, gradient or tiny text.
Limitation of liability
Please test-stitch every new file before running production. To the fullest extent the law allows, our total liability for any claim connected to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, including wasted garments, thread or machine time, lost profits or lost business, however they arise. Nothing in these terms limits any right you have that cannot be limited by law.
Acceptable use of the site
Do not try to access other customers' accounts or files, interfere with the site, upload harmful files, or use automated tools to copy our content. Our free tools, such as the DST viewer and stitch estimator, are provided as they are, for general guidance.
Governing law
These terms are governed by the laws of the United States and of the state in which 95 Solutions LLC is registered, without regard to conflict of law rules. If you are a consumer, you may also have rights under the laws of the country where you live, and these terms do not take them away. Before starting any formal dispute, please email us so we can try to resolve it directly.
Changes to these terms
We may update these terms from time to time. The version on this page when you place an order applies to that order. If we make significant changes, we will let account holders know by email. If a part of these terms is found to be unenforceable, the rest still applies.
